What is personal data?
Personal data is information that can be used to identify a living person including property or lands information (e.g. farm data).
NI Water is the controller of the personal data that is collected in connection with the Farm Chemical Disposal Scheme because we determine the purposes for and the manner in which any personal data is processed.
Lawful Processing
The Data Protection Laws state there must be a lawful basis for processing your personal data. As the Data Controller, NI Water lawfully processes any non-sensitive, personal information you provide in association with your application for the Farm Chemicals Disposal Scheme, under the lawful basis Public Task in the public interest i.e. protecting the water supply.
For any Special Category (sensitive) personal information you provide in association with your application for the Farm Chemicals Disposal Scheme, e.g. within the free text comments field, drawing our attention to a medical condition you may have which necessitates special disposal arrangements etc., the lawful basis for processing will be under Substantial Public Interest.
If you ticked any of the boxes above to learn more about NI Water’s Sustainable Catchment Area Management Programme (SCAMP) work, e.g. Rush Control, Water Quality Protection etc., NI Water lawfully processes this non-sensitive, personal information under the lawful basis Consent.
McQuillan Environmental are a processor of personal data in that in their supplier role to NI Water, they lawfully process a small sub-set of personal information, to ensure compliance with NI Waste Legislation.
The Northern Ireland Environment Agency (NIEA) are a Data Controller in their own right in their role as an Executive Agency within the Department of Agriculture, Environment and Rural Affairs, with a primary purpose to protect and enhance Northern Ireland’s environment, and in doing so, deliver health and well-being benefits and support economic growth.
Retention
Applications that include personal information will be securely archived and retained for three years after the end of the Scheme, then securely destroyed.
What data (including personal data) we collect and what we do with it
Title, first name, surname, main correspondence address, telephone number, email address and registrant signature, will be collected to perform the services under the Scheme of collecting farm chemical waste by McQuillan Environmental and used to comply with Northern Ireland waste legislation.
Your rights as data subject
The ICO provides details online about your rights as a Data Subject.
You can tell NI Water or its processors that you want to exercise any of your available rights, and they will promptly pass that request to NI Water (as controller).
The authority responsible for overseeing data protection matters in Northern Ireland is the Information Commissioner’s Office (ICO).
